2. SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the Parties, pursuant to Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) ordered electronically by the BUYER through the website www.kurshuni.com.tr, the characteristics and sale price of which are specified in the order summary.

3. PRODUCT(S) SUBJECT TO THE AGREEMENT AND PRICE

The type, quantity, brand/model, sale price, shipping cost, payment method, and delivery information of the product(s) subject to the Agreement are as stated in the order summary.

Note: The information contained in the order summary and payment screen forms an integral part of this Agreement.

4. GENERAL PROVISIONS

4.1. The Buyer accepts that they have read and been informed about the basic characteristics, sale price, payment and delivery information of the product subject to the Agreement, as well as the preliminary information regarding the right of withdrawal, on the website www.kurshuni.com.tr, and that they have provided the necessary approval electronically.

4.2. The Seller shall deliver the ordered product(s) to the delivery address provided by the Buyer during the order process, within the legal time limits specified in the applicable legislation.

4.3. Although product delivery may vary depending on stock status and the distance of the delivery address, it shall be completed within the legal period of no later than 30 (thirty) days. The Seller shall exercise reasonable care to ensure that the delivery process is carried out properly.

4.4. In cases such as the inability to supply the product or the impossibility of performance, the Seller shall inform the Buyer and refund the amount collected no later than 14 (fourteen) days.

4.5. If the Buyer does not pay the price of the ordered product or cancels it in the bank records, the Seller shall have no obligation to deliver the product.

5. DELIVERY AND PERFORMANCE

5.1. The product(s) shall be delivered to the address and to the person(s) specified by the Buyer during the order process.

5.2. The Seller shall not be directly responsible for delays caused by the cargo company, but shall provide reasonable support to ensure that the process proceeds properly.

5.3. If the Buyer is not present at the specified address during delivery, the delivery procedures of the cargo company shall apply.

5.4. Once the product is delivered to the person(s) at the address specified by the Buyer, the delivery shall be deemed to have been made to the Buyer.

6. RIGHT OF WITHDRAWAL

6.1. Within the scope of distance contracts, the Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date the product is delivered to them or to the person/organization at the address they have indicated, without giving any reason.

6.2. In order to exercise the right of withdrawal, the BUYER must notify the Seller in writing within the withdrawal period. This notification may be made by sending an email to customer@kurshuni.com or by contacting the WhatsApp line at 0538 394 1193. Following this notification, instructions regarding the return process shall be provided to the BUYER.

6.3. When the right of withdrawal is exercised;

• The product must be returned completely together with its box, packaging, accessories, if any, and all documents.
• The product must be unused and in a resalable condition.

6.4. If the right of withdrawal is exercised, the product price shall be refunded to the Buyer within 14 (fourteen) days. The refund shall be made using the same payment method used by the Buyer.

6.5. If there is a loss in value resulting from the use of the product during the return process under the right of withdrawal, the BUYER may be held responsible for such loss in value.

7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products prepared in line with the Buyer’s requests or personal needs, or for products that cannot be returned by their nature.

In addition, under the applicable legislation, the right of withdrawal cannot be exercised in the following cases:

• Products manufactured/customized specifically in line with the Buyer’s requests
• Products whose prices change depending on fluctuations in financial markets and are beyond the Seller’s control
• Products unsuitable for return due to hygiene reasons (earrings)

8. RETURN AND RETURN PROCESS

8.1. The product to be returned under the right of withdrawal must be sent to the Seller within 14 (fourteen) days from the date the withdrawal notice is made.

8.2. The return shipping process and method shall be subject to the principles set out in the Seller’s return procedure.

8.3. In returns made under the right of withdrawal, if the product is sent through the contracted cargo company specified by the Seller, the shipping fee shall be borne by the Seller. If the shipment is made through a different cargo company, the shipping fee shall be borne by the Buyer.

9. RESOLUTION OF DISPUTES

In disputes arising from this Agreement, within the monetary limits determined each year by the Ministry of Trade of the Republic of Türkiye, the following authorities shall have jurisdiction:

• Provincial/District Consumer Arbitration Committees
• Consumer Courts

shall be authorized.

10. EFFECTIVENESS

By placing an order through www.kurshuni.com.tr, the Buyer accepts that they have read, understood, and electronically approved all the terms of this Agreement.

This Agreement shall enter into force on the date it is electronically approved by the Buyer.
